TINJAUAN HUKUM ISLAM TERHADAP SERTIFIKAT PRANIKAH DAN IMPLEMENTASINYA DALAM PERNIKAHAN MUSLIM DI INDONESIA
Abstract
Abstract
This article examines the Islamic legal view on premarital certificates and their implications for Muslim marriages in Indonesia. Using a normative analysis method, this study discusses how the Qur'an, Hadith, and ijtihad of scholars view premarital preparation and whether the premarital certificate policy is in line with Islamic teachings. In addition, this article also explores how the implementation of this policy in Indonesia impacts Muslim society, especially in the legal and social contexts. The results of the study show that although premarital preparation is highly recommended in Islam, premarital certificates as an administrative requirement are not an obligation in sharia. However, this policy can be considered a positive preventive effort when viewed from the aim of improving the quality of marriage and preventing divorce, as long as it is implemented by considering Islamic principles and the social conditions of society.
