Abstract

This discussion is motivated by the problem of the increasing number of divorce cases via social media. Which is formulated into the following problem formulation: How is divorce implemented via social media (Whatsapp) in East Kosambi Village, District. Kosambi District. Tangerang?, and what is the validity of divorce via social media (Whatsapp) according to Islamic Law in East Kosambi Village, District. Kosambi District. Tangerang. The method used in this research is a qualitative field study, namely by referring to primary sources, namely eight informants who were interviewed related to the problems studied in East Kosambi Village, Kosambi District, Tangerang Regency. The approaches used in this research are firstly a normative approach, namely an approach that refers to values, both those originating from the Al-Qur'an and As-Sunnah as well as norms that apply in society and secondly a sociological approach, namely an internal approach. understand religion, which connects the development of society to knowing the developing social conditions. The results of the research show that first, the implementation of divorce via social media in East Kosambi Village is classified into four types: (1) carried out only via WhatsApp messages and not said directly or outside the religious court; (2) carried out without the family or witnesses knowing; and (3) the factors that cause this occurrence are on average economic, but there are also factors such as infidelity and underage marriage. Second, divorce law in Islam often gives rise to misunderstandings, as if Islamic teachings give men greater rights than women. However, how carefully Islamic law regulates divorce matters. It would not be wrong to say that no religion or human rule is equal to it. The rights of men and women are so balanced that they reflect a noble sense of justice.
